EEOC 2017 Litigation Data and EPL Protection

The EEOC  (Equal Employment Opportunity Commission)  released their data for workplace discrimination charges that were filed with their Agency in 2017.  The total was in excess of 84,000 plus an additional 6,696 claims for sexual harassment.

Claims of Retaliation were the most frequently reported  claim – here is the link for more details: EEOC Report

A good
EPLI  (Employment Practices Liability Insurance) Policy will include Coverage for claims of Retaliation (actual or alleged) and much, much more.

However, it is very important to note that the EEOC fiscal year ended Sept. 30, 2017 – meaning it does not include any reports after that date –  the Harvey Weinstein Case broke on 10/05/2017

Who needs EPLI:

Any Employer.

Very Important to Note:

If an Employer has a claim and they do not have EPLI Protection, the prospect of securing coverage in the future will be very challenging if not impossible.

Insurance Companies do not want to provide coverage for  Businesses that have had Discrimination claims because it is not uncommon for copycat claims to follow from additional employees, especially if they witness another employee benefiting financially.
