Loss Control and OSHA Violations


In addition to the positive impact Loss Control has on Insurance Premium (e.g. a Credit
Experience Mod. Rating), excellent Loss Control Policies can also help an Employer avoid OSHA violations.

OSHA Violation Penalty

The Maximum Penalty for an OSHA violation* (as of Jan 2017) is $12,675 Per violation and the same amount each day the employer fails to correct the violation.  This is up from $7,000 last summer. 


For smaller Employers, a Penalty of this size, could be devastating. 

Construction Employers


Construction Employers
face their own unique risks since the employee that is assigned to Loss Control, can’t be at every project site and Loss Control is typically not the employee’s only job duty.  


Additionally, construction Employers may have
a higher exposure to new hires as projects dictate (e.g. day laborers or subs for larger but short term projects).  Accordingly, they will not be versed in your safety culture.  


Weekly and pre-project Safety Talks can go a long to help control the incidence of work related injury and avoid an OSHA violation.  It will also help
reinforce the importance you place on Safety and providing a safe working environment for your team.
